Terms of service
These terms govern your use of CareStead. By creating an account you agree to them on behalf of your organisation.
1. The service
CareStead provides cloud software for care home record keeping, including eMAR, care plans, daily notes, incidents, CQC evidence export (England), and a family portal. CareStead is not a medical device and does not provide clinical advice or replace professional clinical judgement.
2. Accounts
You must provide accurate organisation and facility details, including your CQC location ID where applicable. You are responsible for the staff accounts and credentials you create, and for promptly removing access for staff who leave.
3. Subscription and payment
Fees are in GBP, billed via Stripe. Tiers are based on registered bed count, as published on our pricing page. A Free tier is available for care homes up to 10 beds at £0/month, no card required. Paid tiers include a 30-day trial with no card required. Subscriptions are month-to-month by default; overage above your tier’s bed cap is billed at £1/bed/month.
4. Data and roles
Your care home is the data controller for resident and clinical records. CareStead is the data processor, acting only on your documented instructions as set out in our Data Processing Agreement. See our privacy policy for full details.
5. Acceptable use
You agree not to use CareStead unlawfully, attempt unauthorised access to any account or system, reverse engineer the service, or resell access without our written permission.
6. Availability and support
We target 99.9% uptime, excluding planned maintenance windows, which we announce in advance where possible. Live status is published at carestead.co.uk/status. Support response targets vary by plan and are documented in-product.
7. Limitation of liability
To the maximum extent permitted by law, CareStead’s total liability arising from or related to these terms is limited to the fees you paid in the 12 months before the claim arose. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
8. Termination
You may cancel a month-to-month subscription at any time, effective at the end of your current billing period. We may suspend or terminate access for breach of these terms or non-payment, after reasonable notice.
9. Changes
We may update these terms as the service evolves. We’ll post material changes here with a new effective date; continued use of CareStead after a change means you accept the revised terms.
10. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
